London High Court - 2024
Objectivus has played a key role in the complex Danish Dividend Tax-Reclaim case currently being heard at the London High Court involving allegations of fraudulent tax refunds in excess of £1.2bn. Furthermore, our experts has been involved for over four years across multiple jurisdictions in this case (London, Copenhagen, Dubai & Malaysia), leveraging our deep knowledge of Cum-Ex dividend arbitrage. Our expertise was required on the following topics: dividend arbitrage, derivatives pricing, double tax treaties, equity market infrastructure, stock borrowing and lending, custody chains, middle and back-office procedures, KYC and AML checks, as well as thorough knowledge of specific EU Regulations and the FCA Handbook.
Tax Court of Canada - 2023
Objectivus provided expert reports and testimony for the appellant in a complex case concerning the tax implications of trading FX swaps and the inherent risks involved. We analysed market practice conventions in the FX market and the structure of the market ecosystem, presenting our findings clearly and concisely to the court. Our expert showcased extensive knowledge of the interconnections between FX swaps, options, forwards, and spot markets, enabling the court to reach an informed judgment.
London High Court- 2022
Our team contributed to a case involving the assessment of a client's knowledge and experience in understanding the risks associated with spread betting and CFD trading. We provided insights into account opening procedures, verification of personal information, and the monitoring of client trading behaviour. Additionally, our expert elucidated irregular market fluctuations in the WTI Light Sweet Crude Oil futures market in April 2020, demonstrating our comprehensive understanding of financial instruments across all asset classes.
